TERMS OF USE
1.1 These Terms of Use (“Terms”) govern your use of the websites and mobile applications provided by FERREN'S COFFEE BAR (or referred to as “us” or "we" or "barista" of ours) (collectively the “Platforms”) and its beverages (collectively the “Products”). Please read these Terms carefully. By accessing and using the Platforms, you agree that you have read, understood and accepted the Terms including any additional terms and conditions and any policies referenced herein, available on the Platforms or available by hyperlink. If you do not agree or fall within the Terms, please do not use the Platforms.
The Platforms may be used by (i) natural persons who have reached 18 years of age and (ii) corporate legal entities, e.g companies. Where applicable, these Terms shall be subject to country-specific provisions as set out herein.
Users below the age of 18 must obtain consent from parent(s) or legal guardian(s), who by accepting these Terms shall agree to take responsibility for your actions and any charges associated with your use of the Platforms and/or purchase of Goods. If you do not have consent from your parent(s) or legal guardian(s), you must stop using/accessing the Platforms immediately.
FERREN'S COFFEE BAR reserves the right to change or modify these Terms (including our policies which are incorporated into these Terms) at any time. You are strongly recommended to read these Terms regularly. You will be deemed to have agreed to the amended Terms by your continued use of the Platforms following the date on which the amended Terms are posted.
1.2 Ferren's Coffee Bar - WHO WE ARE
Handcrafted Beverages: Fresh-brewed coffee, hot and iced espresso beverages, Iced Coffee, Cold Brew, third wave coffee and non-coffee blended beverages, Ferren’s Coffee Bar's beverages, and teas.
WHERE WE ARE
In light of our expanding branch network, it is essential to note that when placing orders via our Facebook Page through Messenger, the designated branch for your service will be Ferren's Coffee Bar, located at our Riverside Drive branch.
Furthermore, we are actively working towards extending this service to our additional branches to accommodate your needs effectively. Thank you for your continued support and patience as we strive to enhance your experience with us.

2. Use of the Platforms and Ferren's Coffee Bar Account
2.1 You will soon need to register for a FERREN'S COFFEE BAR account for you to use the Platform. When you register for a FERREN'S COFFEE BAR account we will ask you to provide your personal information including a valid email address, a mobile phone number and a unique password. To purchase an Order, depending on which payment method you opt for, you may need to provide us with your payment details and a proof of payment like deposit slip or a screenshot of your bank transfer (For security, please shade to cover up your bank account number). Your unique password should not be shared with anyone and you agree to keep it secret at all times. You are solely responsible for keeping your password safe. Save for cases of fraud or abuse which are not your fault, you accept that all Orders placed under your FERREN'S COFFEE BAR account are your sole responsibility.
2.2 FERREN'S COFFEE BAR shall not be liable for Orders that encounter delivery issues due to incomplete, incorrect or missing information provided by you. You are obliged to provide information that is complete, accurate and truthful for the proper processing of the Order, including your delivery address and contact information.
2.3 If you wish to delete your FERREN'S COFFEE BAR account, please send us an email requesting the same. We may restrict, suspend or terminate your FERREN'S COFFEE BAR account and/or use of the Platforms, if we reasonably believe that:
2.3.1 someone other than you is using your FERREN'S COFFEE BAR account; or
2.3.2 where you are suspected or discovered to have been involved in any activity or conduct that is in breach of these Terms, our policies and guidelines, or involved in activity or conduct which we deem in our sole discretion to be an abuse of the Platforms.

Essential goods and services
In view of the decrease in community transmission over the past month, the IATF Philippines allows selected activities and services to be resumed gradually. This includes the manufacturing and onsite preparation of all food, including cakes and confectionery, ice cream, cocoa, chocolate and chocolate products, and other snacks; as well as the opening of retail outlets of food, including cakes and confectionery, packaged snacks and desserts, for takeaway and delivery only. 3. Orders
3.1 When you place an Order with FERREN'S COFFEE BAR, we will confirm your order by sending you a confirmation Facebook Messenger's message or email containing the Order. Where applicable, Orders will include delivery fees and any applicable tax (e.g. goods and services tax, value-added tax, etc.).
3.2 Whenever applicable, Minimum Order Value - Some of our Vendors require a minimum order value (“MOV”) before an Order can be placed and delivered to you. Where an applicable Order fails to meet the MOV, you will have the option of paying the difference to meet the MOV or to add more Goods to your Order.
3.3 Special Instructions – FERREN'S COFFEE BAR reasonably endeavour to comply with your special instructions for an Order. However in some cases where this is not feasible, possible or commercially reasonable, FERREN'S COFFEE BAR reserves the right to proceed to prepare the Order in accordance with standard operating procedures. FERREN'S COFFEE BAR shall not be responsible to replace or refund an Order which does not conform to special instructions provided by you.
3.4 Allergens
While we take precautions to keep ingredients separate, we cannot guarantee that any of our beverages or foods are allergen free as we use shared equipment to store, prepare and serve them. Examples of shared equipment include the espresso machine steam wand, blender and pastry case. Please consult your doctor if you have questions about food allergies, so that you can make the decision that is right for you.
FERREN'S COFFEE BAR is not obligated to provide ingredient information or allergen information on the Platforms. Furthermore, FERREN'S COFFEE BAR does not guarantee that the Goods made and sold by us are free of allergens. If you have allergies, allergic reactions or dietary restrictions and requirements, please contact us before placing an Order on our Platforms.
Allergy information: most of our products' ingredients are manufactured in local or foreign food factory that processes soya and nuts.
3.5 Prior to placing the Order
3.5.1 You are required to provide the delivery address, if it's for delivery, in order for us to know how to go to the delivery area.
3.5.2 Once you select an item, you will be taken to Facebook Ferren's Coffee Bar Messenger with pre-made Ask questions (i.) Order, (ii.) Menu, show me please, and (iii.) Pickup buttons for you to select and state your orders:

3.6 Placing the Order
To complete an Order, please follow the onscreen instructions after clicking ‘Checkout on website’ from the Shop tab of Ferren's Coffee Bar Page. You may be required to provide additional details, such as Google Map address screenshot, for us to complete your Order. You are required to review and confirm that all the information you provide, including the amounts, delivery details, personal details, payment information, and voucher codes (if applicable) is true, accurate and complete before we consider it as a “PLACED ORDER”. An Order is successfully placed when you receive a Messenger message or an email confirmation containing your Order receipt from us.
If your order is placed using a credit card, if applicable, such card should be valid on the date of delivery of your order.
A Senior Citizen (SC) or Person with Disability (PWD) discount may be applied on the delivery transaction, provided you comply with the Delivery Conditions stated here.
We reserve our right to refuse to deliver any order if for whatever reason we believe that payment will be refused at any stage.
3.7 Cancelling an Order
3.7.1 Please contact us immediately via our Facebook Page in-app customer support chat feature if you wish to cancel your Order after it has been placed. You have the right to cancel your Order provided a barista has not yet accepted and prepared your Order and treated as a “PLACED ORDER”.
3.7.2 Refunds
(i) Online Payment Orders
You have the right to a refund for a cancelled Order only if a barista has not yet prepared your Order. Should you still decide to cancel your Order after it has been prepared by the barista of ours, you understand that no refunds (whether in whole or in part) will be issued to you and you forfeit the delivery of your cancelled Order.
(ii) Cash-on-Delivery Orders
You have the right to cancel your Order only if a barista has not yet accepted your Order. Should you still decide to cancel your Order after it has been accepted by the barista, you understand that you shall forfeit the delivery of your cancelled Order and cash-on-delivery (COD) may be removed from your list of available payment methods for your future orders.
3.8 FERREN'S COFFEE BAR reserves the right to cancel any Order and/or suspend, deactivate or terminate your FERREN'S COFFEE BAR account in its sole discretion if it reasonably suspects or detects fraudulent behaviour or activity associated with your FERREN'S COFFEE BAR account and/or with your Order.
3.9 Delivery Conditions
You agree to accept delivery of the Products at the agreed time and place of delivery, subject to the specific delivery conditions below:
Delivery Time
The arrival time in our delivery service guarantee will be based on our rider’s arrival at the gate of your subdivisions, villages, factories, industrial areas and other gated communities (as the case may be); while the arrival time in buildings, hospitals, condominiums and hotels will be based on our rider’s arrival at the lobby.
We shall exert reasonable efforts to meet the guaranteed delivery time, where applicable. You understand and accept, however, that any delay due to traffic, inclement weather or similar or analogous conditions or circumstance, are beyond our control and should not at any time be taken against us.

Delivery Charges
All prices are excluding delivery charges. The delivery fees help pay our local driver partners, provide the best service possible, and supporting the initiative to encourage properly organised delivery freelancers and thus help boost the economy.
As at this writing, April 2020, delivery charges apply - PhP 25 to P40 location dependent. That is for the pilot Ferren's Coffee Bar's nearby area such as Life Homes to Junction (near Cainta, Rizal).
For beans delivery, Foodpanda, Grab or Lalamove delivery charge apply. Please check their respective delivery charges or estimates based on your location. Limits on deliveries apply: Lalamove and Grab PH. Lalamove and Grab act as Philippine transport, delivery and logistics service provider. Their delivery fees are calculated based on distance, and will depend on the merchant’s location.

Product Availability
You understand and agree that Product/s are subject to availability at the time of delivery. If the Products you ordered are not available, we may offer you a reasonable substitute Product or equivalent quality and price or we may advise you through phone call (local Philippines), SMS, Messenger, or electronic mail for alternative Product/s. You understand that should you choose to order other Product/s, this may affect the purchase price.
ID Validation
For some transactions payable upon delivery, you will be requested to present a valid ID to our delivery rider for validation.
If a Senior Citizen (SC) or Person with Disability (PWD) discount was applied on the delivery transaction, the SC or PWD must be physically present at the time and place of the delivery, and the SC or PWD card must be presented to our rider for validation.
Rider's welfare
He's wearing face mask, gloves and jacket. Ferren's Coffee Bar ensures customers that its delivery equipment are sanitised before and after each use, and riders follow contactless delivery.
